Ex Ordered to Insure Children

Last week my ex-husband was court ordered to include our 2 kids on his insurance. This means I will have to pay the deductables for each kid. Right now they have medicaid. Do I have to cancel my medicaid? Do I even have to report the new insurance?

While nothing has happened just yet, this is all good advice. Thanks to everyone. I guess it will pretty much depend on how good his insurance is. Thanks again.

You shouldnt have to cancel the medicaid, but you will have to report it. If I remember correctly they will make you medicaid as the secondary. Good luck! C.

If you don't report that they have new insurance that's Medicaid fraud and not something you really want to get into. Medicaid is to be used as a last resort. When you have the ability to have other coverage you need to use it and open the funds for the next person in need. And it will show up that the kids have other insurance eventually. My kids and I had Medicaid while my husband was in school and even though he qualified too he couldn't use it because he had mandatory health insurance thru school and it showed in their system.

Now depending on your state you might be able to use Medicaid like a co-insurance. Check with your caseworker.

If you can't afford the deductibles then show proof of that to the courts to see if they can have you and the ex split the cost of the deductibles.

You'll have to report it but they may not cancel you. In my state, medicaid would be the secondary and cover what your insurance doesn't cover. Good luck to you!

In IL you do not have to cancel Medicaid. Plus sometimes dads don't always pay the insurance so keep them both.

If you qualify keep everything you can, Def. notify Medicaid about hte new insurance and they will let you know what your options are.

If there has been no change in your income you should not lose your medicaid. However, I think you are supposed to let them know if you get new insurance. Medicaid will then become the secondary. Pretty sure that's how it goes. Good luck! :)

You will have to tell Medicaid about your ex-husband covering them on his insurance. Make sure you get the effective date the insurance coverage starts on his insurance before you call Medicaid because they will ask for that information. If you don't tell Medicaid they will probably find out later on and you could be in trouble for fraud and be required to pay medicaid back the money the paid that was in error. However, you can see if Medicaid will still provide coverage as a secondary insurance and see if they will pick up any deductibles, coinsurance or copays that is not covered by your ex-husbands insurance.

We have Medicaid as our secondary insurance for our daughter. It was the main thing we had for awhile. Our regular insurance now pays for most with her and whatever is denied or not paid in full medicaid picks up. When you fill out paperwork at doctor's offices and hospitals you put the main insurance that they will now be under as the first one and medicaid info for the Secondary insurance. Forms always have that now to fill in.

Yes you have to report the insure (typically the courts are connected with Medicaid and other state agencies so they may find out about the order anyway). You don't need to cancel your medicaid but you do need to notify them. Once the insurance actually starts, it is possible that Medicaid would become secondary (or could be cancelled) so check w/ your contact there.

My ex is court ordered to provide medical insurance, but the courts also said he is responsible for 80% of what insurance doesn't cover. It's split 80/20, based on our income. If i can provide insurance on our daughter, i am also court obliged to do so. At this point, she is doubly covered by her Dad's insurance, and her step-fathers. But, her dad still pays 80% of whatever medical cost is left over. As for the Medicaid, not 100% sure, but i'm thinking you will not have to cancel it...just report the new insurance coverage & your medicaid becomes secondary.

My children have medicaid and also private insurance. The medicaid is secondary and it pays the co-pays and deductibles and also anything my insurance does not cover, such as counseling.
You should be able to have both, but you will have to contact the medicaid people about it.

You must notify your medicaid worker of ANY changes within 10 days. Send them a letter, or stop by their office if you are able. Let them know that your children are now insured by a primary insurance as per a court order. Make a copy of the benefits card, and let them know what the deductible is and the percentage the insurance will pay, also provide a copy of the court order. You do not have to cancel. If you are still eligible, the medicaid will be a secondary insurance. If benefits max out for some reason (major surgery, many doctor's appt due to chronic illness) the secondary will be a big help. Also, if you were eligible for coverage before, you should still be eligible. Check out this website: http://member.indianamedicaid.com/
OR, talk to your medicaid worker or a supervisor in the office, they should be helpful and answer your questions. If they aren't take their name and complain. I believe that you can have insurance AND medicaid. It will depend on your income. Call them and ask. I had both for about a year and medicaid paid all the copays and deductibles after the insurance paid its part.

Of course you have to report it. Do you have full custody? If you do, then you can probably get him ordered to pay at least part of the deductibles as well. If not, then paying the deductibles while he pays the insurance sounds fair to me.

I guess I am wondering why you have to pay the deductable. If your ex pays health insurance he should pay deductable. My hubs has his son from previoous relationship on his insurance, court mandated, and pays for everything including deductable.
